ABOUT THE EVENT
This presentation will introduce you to the state and federal privacy laws that class action plaintiffs’ lawyers have wielded against beauty industry websites.  Michael Duvall and Kelly Graf of Dentons US LLP will discuss the wave of lawsuits and demand letters under the California Invasion of Privacy Act (CIPA), the Illinois Biometric Information Privacy Act (BIPA), and the federal Video Privacy Protection Act (VPPA) and outline the best ways to reduce the risks of a website privacy class action lawsuit.  Website features that will be covered include the use of chat boxes, virtual try-on tools, and the display of product videos while using a tracking pixel.  ABOUT THE SPEAKERS Michael Duvall, Partner, DentonsMichael Duvall is in Dentons' Litigation and Dispute Resolution practice, defending companies in consumer class actions, complex litigation, and related regulatory actions. Michael’s experience spans many levels, including successfully trying class actions, securing judicial approval of complex settlements, arguing appeals in federal and state appellate courts, and litigating class action questions in the US Supreme Court. Michael also advises companies on potential class action risks in connection with possible labeling changes, new advertising campaigns, potential corporate transactions, and other strategic initiatives. He also has experience in data privacy, security and incident response litigation, alleged unlawful call recording actions, employee misclassification and similar collective actions, and business shareholder litigation. Michael also actively represents consumer product companies in intellectual property litigation involving copyrights, patents, trademarks and trade dress. Michael is based in Los Angeles, but his practice is national in scope, and he regularly defends his clients in popular litigation forums such as California, New York, New Jersey, Illinois, Texas and Missouri. Kelly Graf, Partner, Dentons Kelly R. Graf is in Dentons' Litigation and Dispute Resolution practice, defending companies in consumer class actions, complex litigation, and related regulatory actions. She has consistently achieved successful results for clients in high stakes disputes in a variety of fields, including the insurance, financial services, and consumer products industries. Kelly’s practice includes defense of clients in class actions alleging violations of California Invasion of Privacy Act claims and frequently presents continuing legal education courses concerning developments in privacy litigation. Kelly also represents clients in product labeling and advertising class actions, and she provides pre-litigation risk management advice on potential labeling changes or advertising campaigns. In addition, Kelly has defended numerous class actions alleging violations of California’s Automatic Renewal Law and advises companies on potential class action risks relating to automatically renewing subscription services.

 

Rebecca Hughes Parker, Counsel, Dentons

Rebecca Hughes Parker is an attorney in Dentons’ Litigation and Dispute Resolution practice, resident in the Firm’s New York office, where she handles all aspects of discovery and trial in federal and state courts, including arbitration and mediation. A Certified Information Privacy Professional (CIPP/US), Rebecca also advises clients on privacy and media law matters.

Rebecca rejoined Dentons in 2023 after more than a decade as an editor, journalist and in-house counsel. She served as the founding Editor-in-Chief of The Cybersecurity Law Report and The Anti-Corruption Report. More recently, she served as in-house counsel for ION, advising on defamation, newsgathering, intellectual property, data privacy, and more for reporters and editors around the world. She also served on Ion’s content executive team. During Rebecca’s previous time at Dentons, she handled a wide variety of general commercial litigation and IP matters as well as white-collar crime cases. Before entering the legal profession, Rebecca was an award-winning news producer at Tribune Broadcasting and Cablevision.
